Samuel Paniccia has handled high-exposure ERISA fiduciary liability claims for insurers while at D’Amato & Lynch for over 28 years. Mr. Paniccia has also acted as monitoring and coverage counsel for many nationally recognized insurance companies in matters of employment practices liability insurance, errors and omissions liability insurance, directors and officers liability insurance, miscellaneous professional liability insurance and accountants liability insurance. Representative cases in which he has been involved include, for example, Curtiss-Wright v. Schoonjongen; In Re Lucent Technologies; Zubulake v. UBS; and, DOL v. GreatBanc Trust Co. (ESOP process agreement). His experience includes attending hundreds of claim settlements, mediations and arbitrations, and representing insurers in coverage mediation, arbitration and litigation. Mr. Paniccia has also been engaged to perform due diligence audits on behalf of insurers and has drafted many insurance policies, endorsements, applications, marketing materials, and other documents used by prominent insurers in the United States and abroad, and to consult with insurers about issues related to developing new insurance products and forms.
