Samuel Paniccia has handled ERISA fiduciary liability matters while at D’Amato & Lynch for over 29 years. Mr. Paniccia also has represented many nationally recognized insurance companies in matters of employment practices liability insurance, errors and omissions liability insurance, directors and officers liability insurance, lawyers professional liability insurance, accountants liability insurance, and miscellaneous professional liability insurance. Representative cases in which he has been involved include, for example, Curtiss-Wright v. Schoonjongen; In Re Lucent Technologies; Zubulake v. UBS; and, DOL v. GreatBanc Trust Co. (ESOP process agreement). His experience includes attending hundreds of mediations, arbitrations, and settlement conferences. Mr. Paniccia has also been engaged to perform due diligence and exposure audits on behalf of insurers of all sizes and has drafted many insurance policies, endorsements, applications, marketing materials, and other documents used by industry-leading insurers in the United States and abroad, and consulted with insurers about issues related to developing new insurance products and forms.
