Peter Stroili is a Partner in D’Amato & Lynch LLP’s Litigation practice group. He has over 25 years of commercial litigation experience focused on complex civil litigation, including the arbitration and litigation of insurance coverage matters, reinsurance, professional liability defense and securities litigation. Mr. Stroili’ s commercial litigation experience includes representing some of the most prominent law firms in New York and corporate officers and directors in securities class-actions and other fiduciary duty litigation. He has handled many high-profile matters as well as cases that encompassed a wide-range of subjects, including arbitration and simultaneous civil litigation relating to the underwriting and financing of a patent enforcement program, click fraud and syndication fraud in connection with internet liability coverage, reinsurance and Medicare fraud.
He has successfully tried to conclusion numerous actions in both state and federal courts, as well as arbitrations before the American Arbitration Association and JAMS with multi-million dollar amounts at stake, including the successful assertion, in arbitration and before the Ninth Circuit, of no coverage for $97 million in tax liabilities under an insured tax plan.
Mr. Stroili has also engaged in extensive appellate practice, including arguing appeals before the New York Court of Appeals and the United States Court of Appeals for the Second and Ninth Circuit Courts. He has successfully argued to expand existing law by compelling non-signatories to arbitrate based on a direct benefit theory and, temporarily extending application of the statute of limitations for medical malpractice to psychologists. His cases have often been featured in Law 360 or the New York Law Journal, including an action for legal malpractice dismissed on appeal against the attorneys for an estate involving the theft of an Old Master painting from an estate in Florence, Italy.
