Reinsurance Representation and Litigation

'Amato & Lynch handles all facets of international and domestic reinsurance dispute resolution, encompassing arbitration, litigation, negotiation and mediation, as well as including regulatory and transactional matters. The firm has represented cedants, reinsurers, reinsurance intermediaries and agents, MGAs and TPAs. The law firm has also advised clients on insurance and reinsurance insolvencies, both domestic and foreign, and on other matters involving significant reinsurance issues.

As a particularly noteworthy example, a number of years ago D'Amato & Lynch, LLP successfully litigated through trial and appeal what is certainly the largest reinsurance litigation ever conducted in the United States arising out of the demise of Mission Insurance Company and its sister company Pacific Reinsurance Management Corporation. The firm represented 23 mainly foreign reinsurers of Mission, which at the time participated in the Pacific Re Pool. The litigation was successfully conducted in California state court and federal bankruptcy courts over a 13-year period, including a trial and numerous appeals.
